Clear information about our services, your recordings and your rights when working with The Tape Project.
1. About these terms
These terms explain how we work when transferring tapes and other media, editing footage, creating Legacy Films, or buying and selling vintage equipment. They should be read alongside your written quotation or order confirmation, which sets out the work, price and arrangements for your particular project.
The Tape Project is a sole trader business. Nothing in these terms limits your statutory consumer rights.
2. Quotes, orders and payment
Before an order is agreed, we will confirm the service or equipment being supplied, the total price including any applicable taxes, payment arrangements, delivery or return costs and any agreed deadline. An enquiry does not by itself create an order.
If an initial estimate needs to change after we inspect your media or equipment, we will explain the reason and seek your agreement before carrying out additional chargeable work. Changes to the scope, extra copies or additional editing must also be agreed before they are charged.
3. Sending us your media
Please describe the formats, quantity and known condition of your tapes, discs, film, photographs or files. Tell us about mould, damage, recording faults or other concerns before sending them. Label items clearly and use suitable protective packaging. Agree the delivery or collection arrangements with us first.
You must own the material or have permission to give it to us for the agreed work. Please obtain any permissions needed from copyright holders and people taking part in newly filmed interviews. We may decline work that would be unlawful or infringe another person’s rights.
4. Transfers and original recordings
We will carry out our work with reasonable care and skill. The result depends in part on the condition and quality of the original recording. Existing picture noise, sound problems, missing sections and deterioration may remain in the transferred files. We cannot promise to recover every recording or restore details that are not present in the source.
We will discuss any material problem that affects the agreed work. Originals remain yours and will be returned under the agreed arrangements. We will not sell, dispose of or retain ownership of them without your separate agreement. These limitations do not excuse damage or loss caused by our failure to use reasonable care and skill.
5. Editing and Legacy Films
Your project agreement will set out the intended film, filming arrangements, delivery format, review stages and included revisions. Please check names, dates and other details you provide. Tell us promptly if a planned interview or filming date needs to change; any revised arrangements and reasonable costs must be discussed and agreed.
Music, photographs and other material must be used with appropriate permissions. Rights in third-party material remain with their owners. We will explain any licence restrictions relevant to the agreed use of your finished film.
6. Delivery and keeping your own copies
We will agree how the finished work and originals are delivered and tell you if an expected completion date changes. If a date is essential, tell us before ordering so we can confirm whether we can meet it.
Please download and check your files promptly and keep your own backup copies. Tell us about any fault or missing item as soon as you notice it. Our working-file retention is explained in our Privacy Policy; a transfer or editing order does not include indefinite storage unless we agree this separately.
7. Cancellation and refunds
If you are a consumer and agree a service contract online, by telephone or otherwise at a distance, you will normally have 14 days from the day after the contract is made to cancel without giving a reason. To cancel, email or write to us using the details below and clearly state that you wish to cancel, identifying your order.
Where you expressly ask us to begin a service during that period, you may have to pay a proportionate amount for work properly supplied before you cancel, provided the required information was given to you. You lose the right to cancel a fully performed service during the period only where the required express request and acknowledgement were obtained. We will not treat a general acceptance of these terms as that request or acknowledgement.
If a separate digital-content supply is to begin during the cancellation period, we will obtain any express consent and acknowledgement required before that supply begins. Personalised work does not automatically remove all cancellation rights.
For qualifying distance sales of equipment, you normally have 14 days after delivery to tell us you wish to cancel and a further 14 days to return it. We will explain return arrangements and any return postage you must pay before purchase. Statutory exceptions, permitted deductions for handling beyond what is necessary to inspect goods, and statutory refund deadlines apply. Faulty or misdescribed goods are dealt with under your statutory rights.
For cancellations outside a statutory cancellation period, any charge must reflect the agreed terms and a fair assessment of work and unavoidable losses, taking account of costs saved. We do not impose a blanket non-refundable deposit rule.
Optional cancellation form
You may use this wording, but do not have to: “To The Tape Project, 108 Larchcroft Road, Ipswich, Suffolk, IP1 6PE, info@thetapeproject.com: I give notice that I cancel my contract for [goods or service]. Ordered on/received on: [date]. Customer name: [name]. Customer address: [address]. Date: [date]. Signature: [only if sent on paper].”
8. Vintage equipment
When buying equipment from you, any offer is subject to the agreed assessment and an accurate description of condition, ownership and included accessories. You must have the right to sell it. We will agree the price, handover and payment arrangements before the sale is completed.
When selling vintage equipment, we will describe its condition and any known faults. Age, price and the description are relevant to what is reasonably expected of a used item, but describing equipment as vintage or used does not remove your statutory consumer rights.
9. Problems and responsibility
If something is wrong, contact us with your order details and a description of the problem so we can investigate and discuss an appropriate remedy. Depending on the circumstances, your rights may include repeat performance, a price reduction, repair, replacement or a refund.
We do not exclude liability for fraud, death or personal injury caused by negligence, or anything else the law does not allow us to exclude. We do not limit statutory rights by reference to the replacement value of an old tape or disc.
10. Privacy, changes and applicable law
Our Privacy Policy explains how we handle personal information and family footage. We will seek separate permission before using your private footage or finished film in publicity.
Updates to these website terms apply to future orders. The terms agreed for an existing order are not changed retrospectively without your agreement. These terms are governed by the law of England and Wales, without taking away any mandatory protections or rights to bring proceedings available to consumers in their home jurisdiction.
